LAKE CHARLES, La. - Two Reglan manufacturers cannot be held liable to a plaintiff who was allegedly injured by ingesting the drug's generic equivalent, a Louisiana federal judge has ruled. Johnson v. Teva Pharmaceuticals USA Inc., No. 10-404 (W.D. La.).
Louisiana state and federal courts have made it clear that brand name drug manufacturers do not owe a continuing duty to consumers of the generic drug equivalent, Judge Patricia Minaldi of the U.S. District Court for the Western District of Louisiana ruled Aug. 16.
