Prempro Case Remanded to Oregon State Court

LITTLE ROCK, Ark. - A Prempro injury case has been remanded to Oregon state court by an Arkansas federal judge who ruled that the defendant physicians defeat diversity jurisdiction and were not fraudulently joined. In re Prempro Products Liability Litigation, MDL No. 4:03-01507, CIV No. 4:10-CV-00409 (E.D. Ark.).

In a July 20 order, Judge William R. Wilson Jr. noted that the complaint alleges that the defendant doctors knew or should have known of the risks associated with the hormone replacement drug and negligently failed to warn plaintiffs of those risks.
