MINNEAPOLIS - A Minnesota federal judge has adopted a magistrate judge's recommendation that a plaintiff be allowed to amend her Mirapex complaint against Boehringer Ingelheim Pharmaceuticals Inc. to plead her fraud claims with the requisite particularity. Burd v. Boehringer Ingelheim Pharmaceuticals Inc., et al., No. 09-807 (D. Minn.).
On June 15, Judge James M. Rosenbaum of the U.S. District Court for the District of Minnesota adopted Magistrate Judge Franklin Noel's May 28 report and recommendation that the plaintiff's fraud claims did not meet the requirements of Federal Rule of Civil Procedure 9(b).
