ST. LOUIS - Avandia injury claims brought against a Delaware drug maker by two plaintiffs are related and therefore the claims of the Delaware plaintiff should not be severed, a Missouri federal judge has ruled. Dickerson, et al., v. GlaxoSmithKline LLC, No. 10-972 (E.D. Mo.).
On July 12, Judge Audrey G. Fleissig of the U.S. District Court for the Eastern District of Missouri ruled that the Delaware plaintiff was not fraudulently joined and is a real party-in-interest.
