Judge Tosses Reglan Injury Claims Against Wyeth, Schwarz Pharma

MOBILE, Ala. - An Alabama federal judge granted summary judgment to Wyeth Inc. and Schwarz Pharma Inc. on Reglan injury claims on the basis that the drug makers did not manufacture the generic metoclopramide dispensed to the plaintiff. Mosley v. Wyeth Inc., No. 09-0284 (S.D. Ala.).
On June 28, Judge Kristi K. DuBose of the U.S. District Court for the Southern District of Alabama ruled that the drug makers did not owe plaintiffs a duty that would give rise to causes of action for fraudulent misrepresentation or breach of warranty.
