CLEVELAND, Ohio - An Ohio federal judge has dismissed metoclopramide injury claims brought against Teva Pharmaceuticals USA Inc., ruling that the drug maker was prejudiced by the plaintiff's untimely service. Fulgenzi v. Wyeth Inc., No. 09-01767 (N.D. Ohio).
On June 10, Judge Sara Lioi of the U.S. District Court for the Northern District of Ohio ruled that the plaintiff failed to provide a good reason for the delay in service.
