BEAUMONT, Texas - Under Texas law, a brand-name drug manufacturer may not be held liable on a failure-to-warn claim asserted by a plaintiff who ingested generic Reglan that was manufactured by another company, a Texas federal judge has ruled. Finnicum v. Wyeth Inc., No. 1:09-785 (E.D. Texas).
In her April 28 decision, Judge Marcia A. Crone of the U.S. District Court for the Eastern District of Texas relied upon rulings by the Texas Supreme Court that product liability is precluded when the defendant did not supply the product that caused the alleged injury.
