CINCINNATI - Paxil birth defect claims brought under the Ohio Product Liability Act against GlaxoSmithKline are not time-barred because plaintiffs could not have been expected to research the drug that was prescribed to them eight years before the company issued its 2005 warning, an Ohio federal judge has ruled. Pettit v. GlaxoSmithKline, et al., No. 2:09-cv-00602 (S.D. Ohio).
On April 13, Judge Algenon L. Marbley of the U.S. District Court for the Southern District of Ohio ruled that the fact that plaintiffs did not file suit within two years of the warning does not bar their claim.
