LOS ANGELES - Failure-to-warn claims brought against the manufacturer of generic Prozac by a woman whose son killed himself after taking the drug are not preempted by federal law, a California federal judge has ruled. Dorsett v. Sandoz Inc., No. 06-07821 (C.D. Calif.).
On March 26, Judge A. Howard Matz of the U.S. District Court for the Central District of California ruled that defendant Sandoz Inc. failed to present evidence that it would have been penalized for issuing a stronger warning label.
