Judge Denies Generic Manufacturer Summary Judgment in Reglan Case

MOBILE, Ala. - An Alabama federal judge has refused to grant summary judgment to Actavis Inc. on Reglan injury claims, ruling that a reasonable juror could infer from the pharmacy records that the drug maker manufactured the generic metoclopramide dispensed to the plaintiff. Mosley v. Wyeth Inc., No. 09-0284 (S.D. Ala.).
On April 5, Judge Kristi K. DuBose of the U.S. District Court for the Southern District of Alabama noted that Actavis' predecessor, Purepac, is listed as the drug manufacturer in connection with each of the three entry sets for "metoclopramide 10 mg tablets" contained in the pharmacy records.
