INDIANAPOLIS - Failure-to-warn claims brought on behalf of a priest who committed suicide after taking Paxil are not barred by the learned intermediary doctrine because the prescribing doctor testified that he was not warned of the risk of suicide associated with the antidepressant, an Indiana federal judge has ruled. Tucker v. GlaxoSmithKline, No. 1:04-cv-1748-DFH-DML (S.D. Ind.).
On March 30, Judge David F. Hamilton of the U.S. District Court for the Southern District of Indiana further ruled that a reasonable jury could find that the drug's 2002 label inadequately warned of the drug's association with an increased risk of suicide.
