BENTON, Ill. - An Illinois federal judge remanded a Zicam loss-of-smell lawsuit to state court, ruling that there is a question as to whether complete diversity exists because the plaintiff's domicile has not been proven. Glisson v. Matrixx Initiatives Inc., et al., No. 10-76-GPM (S.D. Ill.).
In a Feb. 22 order, Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois explained that it is well-settled in the 7th Circuit that "jurisdictional allegations made on information and belief, rather than personal knowledge, is insufficient to invoke the diversity jurisdiction of a federal court."
