LITTLE ROCK, Ark. - The 8th Circuit U.S. Court of Appeals has ordered a new punitive damages trial in a hormone replacement injury case, ruling that the evidence would allow a jury to find or infer that Wyeth recklessly and maliciously failed to properly test its HRT drug and issue adequate warnings concerning potential side effects. Scroggin v. Wyeth, et al., Nos. 08-2555, 08-2711, 08-2713. (8th Cir.).
In a Nov. 2 opinion, the appellate court also upheld the compensatory damages against both Wyeth and Upjohn Company L.L.C.
