BENTON, Ill. - An Illinois federal judge has remanded to state court for lack of federal subject matter jurisdiction a Levaquin injury case brought against Johnson & Johnson and Walgreen Co. Doles, et al. v. Johnson & Johnson, et al., No. 09-862 (S.D. Ill.).
On Oct. 19, U.S. District Judge G. Patrick Murphy of the U.S. District Court for the Southern District of New York ruled that the defendants failed to establish that Walgreens was fraudulently joined.
