BENTON, Ill. - An Illinois federal judge has remanded a Trasylol personal injury case to state court, ruling that an out-of-state plaintiff was not fraudulently joined. Bankcroft v. Bayer, No. 09-787 (S.D. Ill.).
Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois further ruled in the Sept. 29 order that he "will remand sua sponte any cases against Bayer that are removed from state court on the basis of the fraudulent misjoinder doctrine."
