Accutane Case Remanded to Pennsylvania State Court

PHILADELPHIA — A Pennsylvania federal judge has remanded an Accutane injury case to state court, ruling that Pennsylvania-based defendant Wolters Kluwer Health Inc. was not fraudulently joined. Boatwright v. Hoffmann-La Roche Inc., et al., No. 12:3115 (E.D. Pa.).

In a one-page order issued June 27, Judge Timothy J. Savage of the U.S. District Court for the Eastern District of Pennsylvania remanded the case to the Pennsylvania Court of Common Pleas.

According to the suit, Andrew Boatright, a Texas resident, was prescribed Accutane in 1997 and was diagnosed with Crohn’s disease in January 1998. Boatright sued Hoffman-LaRoche Inc., Roche Laboratories Inc. …
