Judge Admits Testimony of Plaintiff's Expert in Remicade Case

BALTIMORE - In a Remicade wrongful death action, a Maryland federal judge on Sept. 29 allowed the testimony of plaintiffs' expert Dr. Donald H. Marks, ruling that his opinions as to general and specific causation are backed by sufficient evidence. Mack v. AmerisourceBergen Drug Corp., No. 08-688 (D. Md.).
However, Judge Richard D. Bennett of the U.S. District Court for the District of Maryland added that the credibility of the testimony may be damaged because it was "substantially" shaped by plaintiff's counsel.
