Federal Judge Sends Accutane Case to Illinois State Court

CHICAGO - An Accutane personal injury case filed against Hoffman-La Roche Inc. has been remanded to state court on the basis of lack of complete diversity of citizenship by an Illinois federal judge. Livingston v. Hoffmann-La Roche Inc., et al., No. 09-2611 (N.D. Ill.).

On Aug. 6, Judge Marvin E. Aspen of the U.S. District Court for the Northern District of Illinois ruled that the plaintiff and the healthcare defendants are all from Illinois and that there was no fraudulent joinder.
