Judge Dismisses Permax, Dostinex Injury Claims Against Par Pharmaceutical

CLEVELAND - An Ohio federal judge has dismissed Permax and Dostinex injury claims brought against Par Pharmaceutical Companies Inc. (PCCI), ruling that the court lacks personal jurisdiction because the plaintiff failed to show that the drug maker manufactured or distributed the drugs in Ohio. Baker v. Eli Lilly & Co., No. 09-666 (N.D. Ohio).
On Aug. 19, U.S. District Judge John R. Adams ruled that PCCI is not liable for the actions of its parent company, which may have manufactured and/or distributed the drugs.
