Wyeth Denied Partial Summary Judgment in Illinois Prempro Case

CHICAGO — An Illinois federal judge has denied Wyeth summary judgment on fraud and negligent misrepresentation claims in a Prempro injury case, ruling that the drug maker’s reliance on previous expert testimony from another case is unpersuasive. Baldonado v. Wyeth, No. 04-4312 (N.D. Ill.).

Judge Amy J. St. Eve of the U.S. District Court for the Northern District of Illinois also denied Wyeth summary judgment on the breach of express warranty claim, finding an issue of material fact as to whether the Prempro label and other materials promised guaranteed heath benefits or no side effects.
