DENVER - The 10th Circuit U.S. Court of Appeals affirmed a grant of summary judgment to Bayer Corp. on Baycol injury claims, ruling that the plaintiff's expert witnesses failed to establish a causal connection between the drug and his injury. Ronwin v. Bayer Corp., No. 08-8089 (10th Cir.).
On June 17, the appellate panel, led by Judge Paul J. Kelly Jr., held that the U.S. District Court for the District of Wyoming did not exceed its authority in denying the plaintiff oral argument on Bayer's summary judgment motion.
