Louisiana Products Liability Act Claims Will Proceed Against Pfizer

MONROE, La. - A Louisiana federal judge has adopted a magistrate judge's recommendation that claims brought under the Louisiana Products Liability Act by a man who was allegedly injured by Pfizer's Chantix be allowed to proceed. Williams v. Pfizer Inc., No 08-1222 (W.D. La.).
Judge Robert G. James of the U.S. District Court for the Western District of Louisiana adopted a report issued by Magistrate Judge Karen L. Hayes, which further recommended dismissal of plaintiffs' claims for punitive damages, intentional tort, unjust enrichment, breach of implied warranty, misrepresentation and concealment because they are precluded by the LPLA.
