LAKE CHARLES, La. - A federal judge has adopted a magistrate judge's recommendation that claims arising under the Louisiana Products Liability Act be allowed to proceed against the makers of the antibiotic Cipro because they were sufficiently alleged. King v. Bayer Pharmaceuticals Corp., et al., No. 09-0465 (W.D. La.).
On July 13, U.S. District Judge Robert G. James of the U.S. District Court for the Western District of Louisiana also adopted Magistrate Judge Karen L. Hayes' recommendation that claims falling outside of the LPLA should be dismissed, as well as claims for punitive damages and attorneys' fees, which are not …
