Ill. Federal Court Remands Hip Implant Case After Challenge to ‘Defendant’s' Standing

BENTON, Ill. — The Judicial Panel on Multidistrict Litigation has vacated the conditional transfer of an Illinois hip implant lawsuit to the Wright Medical Technology MDL after the transferor court granted the plaintiff’s motion for remand. Bond v. Wright Medical Technology Inc., et al., No. 12-cv-597-DRH-DGW (S.D. Ill.).
The action came after Chief Judge David R. Herndon of the U.S. District Court for the Southern District of Illinois agreed with plaintiffs that Wright Medical lacked standing to remove the action from state court because it was a “respondent in discovery” rather than a defendant.
