MDL Judge Dismisses Claims Against Generic Propoxyphene Manufacturers

COVINGTON, Ky. — The judge overseeing the Darvocet, Darvon and Propoxyphene multidistrict litigation has dismissed the remaining claims against the generic drug makers with prejudice, ruling that they are preempted under PLIVA Inc. v. Mensing. In re Darvocet, Darvon and Propoxyphene Products Liability Litigation, MDL No. 2:11-2226-DCR (E.D. Ky.).
On June 22, Judge Danny C. Reeves of the U.S. District Court for the Eastern District of Kentucky ruled that the plaintiffs failed to show why Mensing should not apply to their claims against the generic defendants.
