ALBANY, N.Y. - A New York federal judge has refused to dismiss a vaccine injury case against Target Corp., Northstar Partnering Group and Summit Health Inc., ruling that it is unclear whether these companies acted as "vaccine administrators" within the meaning of the National Childhood Vaccine Act. Arakelian v. Target Corp., et al., No. 08-CV-970 (N.D. N.Y.).

In a May 7 order, Judge Gary L. Scharpe of the U.S. District Court for the Northern District of New York also dismissed the suit as to Favorite Healthcare Staffing Inc., noting that Favorite acted as a vaccine administrator as defined by the …
