LITTLE ROCK, Ark. - Claims brought against Wyeth and Schwarz Pharma Inc. by a woman who says she was injured by the generic form of metoclopramide fail because she never took the drug manufactured and sold by the brand name defendants, an Arkansas federal judge has ruled. Fields v. Wyeth Inc., No. 08-2079 (W.D. Ark.).

Judge Robert T. Dawson of the U.S. District Court for the Western District of Arkansas ruled May 11 that the claims constituted a "product liability action" under Arkansas law and that plaintiff failed to meet her burden of product identification.
