Plaintiff Files Motion to Remand Thimerosal Action, Argues Defendants Failed to Comply with Removal Statute

SCRANTON, Pa., - Plaintiffs in a class action suit against several manufacturers of vaccinations containing mercury-based thimerosal have filed a motion to remand the case to common pleas court on the grounds that the defendants failed to comply with the removal statute. Shadie, et al. v. Aventis Pasteur Inc. et al., No. 03:02cv0702 (M.D. Pa.).
According to a brief filed April 30 in support of the motion, George Shadie and other members of the putative class argue that the case should be remanded because just one of the defendants' petitions for removal was filed within the 30-day statutory limit.
