RENO, Nev. - A Nevada federal judge has dismissed failure-to-warn claims brought against the maker of generic Reglan, ruling that the drug ingested by the plaintiff was approved by the Food and Drug Administration and copied the label of the Reference Listed Drug for metoclopramide. Moretti v. Pliva Inc., et al., No. 08-396 (D. Nev.).
On Aug. 30, Judge James C. Mahan of the U.S. District Court for the District of Nevada granted Pliva Inc. summary judgment, ruling that the label on the drug was adequate as a matter of law.
