CLEVELAND - An Ohio federal judge has refused to vacate or alter a judgment granting Wyeth and other defendants summary judgment on claims that the diet drug Redux caused a woman to contract primary pulmonary hypertension. Longs v. Wyeth, et al., No. 1:03 CV 2042 (N.D. Ohio).
In a March 20 order, Judge Solomon Oliver Jr. of the U.S. District Court for the Northern District of Ohio ruled that the plaintiff failed to support her argument that the court should reconsider its ruling that her claims are preempted by the Federal Drug and Cosmetic Act.
