RENO, Nev. - In a lawsuit brought by a woman who says she was injured by the generic form of metoclopramide, a Nevada federal judge has ruled in favor of Wyeth Inc. and Schwarz Pharma Inc., finding that they owed no duty of care to the plaintiff. Moretti v. Wyeth Inc., No. 2:08-CV-00396 (D. Nev.).
In a March 20 order, Judge James C. Mahan of the U.S. District Court for the District of Nevada held that the drug manufacturers do not owe a duty to warn about the risks associated with their generic competitors' drugs.
