TRENTON, N.J. - A state appeals court has vacated a $2.6 million verdict awarded to a man who suffered severe gastrointestinal injuries as a result of ingesting Accutane. McCarrell v. Hoffman-La Roche Inc., No. A-3280-07T1 (N.J. Super. Ct., App. Div.).
In a decision issued March 12, the New Jersey Superior Court Appellate Division remanded the matter for a new trial, determining that the trial judge erred when she prevented jurors from hearing prescription data that would have placed into better context the number of similar injuries that have been reported among Accutane users.
