Judge Says Revised Accutane Warning is Too 'Ambiguous'

ATLANTIC CITY, N.J. - A New Jersey state judge has denied summary judgment to the makers of Accutane, ruling that a revised warning is not adequate as a matter of law because it does not directly address the risk of inflammatory bowel disease. In re Accutane Litigation, No. 271 (N.J. Super., Atlantic Co.).

In a Dec. 10 order, Judge Carol E. Higbee of the Atlantic County Superior Court further ruled that the language in the revised warning is too ambiguous to meet the "adequate warning" standard of the New Jersey Products Liability Act.
