Appeals Court Returns Case for New Trial on Damages

COLUMBUS, Ohio - An Ohio appeals court has ordered a new trial on damages related to mold in a property that was the subject of a lease-purchase deal, ruling that the jury award of "$0" damages was inconsistent with its finding of liability on the breach of contract claim. Meyer v. Chieffo, No. 07AP-890 (Ohio Ct. App., 10th Dist.).
The 10th Appellate District also said in its Dec. 16 opinion, however, that it agreed with the trial court's refusal to instruct the jury on the appellant's personal injury claim, noting there was no expert testimony supporting the allegation.
