N.Y. Court Dismisses Tenants' Remaining Claims for Bodily Injury

NEW YORK - A New York court that has already dismissed property damage claims by tenants who complained of water and mold contamination has granted defense motions for summary judgment on the remaining claim for "toxic chemical exposure." Biton v. State Farm Insurance, et al., No. 601732/2002 (N.Y. Sup. Ct., N.Y. Cty.).

New York County Supreme Court Justice Walter B. Tolub said in his Dec. 2 order that plaintiff Crystal Biton's pro se response to the motions failed to provide any objective evidence to support her newly offered claim of toxic exposure from floodwaters that entered her apartment in 2002.
