NEW YORK - A New York state court judge has denied plaintiff and defense motions to dismiss, calling both premature given the dispute over the ownership of the property at issue. Wygate Realty Corp. v. Boiselle, No. 30298/07 (N.Y. Sup., Queens Cty.).

Queens County (N.Y.) Supreme Court Justice Orin R. Kitzes gave defendant Charles Boiselle 20 days to amend his answer to raise an ownership defense. The justice also ruled that Wygate Realty Corp. can then have the same amount of time to amend its complaint in light of any new information provided by Boiselle.
