NEW YORK - A New York trial court has denied a condominium owner leave to add a claim for punitive damages to her nuisance counterclaim against her building managers, finding no evidence of outrageous behavior or malicious intent. Board of Managers of the Waterford Association Inc. v. Samii, et al., No. 114054-2004 (N.Y. Sup., N.Y. Cty.).
Justice Carol R. Edmead of the New York County Supreme Court said in her Sept. 18 order that Negar Samii's allegations of wrongdoing by the Board of Managers of the Waterford Association Inc. were insufficient to allow her to amend the counterclaim.
