LITTLE ROCK, Ark. - The Arkansas Court of Appeals has ordered a trial court to recalculate damages for a homebuyer who was granted a default judgment on mold and defect claims against the sellers. Shea v. Coran, No. CA07-1259 (Ark. Ct. App.).
The court ruled in its Sept. 24 opinion that the trial court misstated the buyer's testimony on the amount of damages he suffered from mold and related problems and, for that reason, should reconsider its award of $9,800 in damages and $8,966 in costs.
