WASHINGTON, D.C. - A federal judge who earlier excluded testimony by tenants' chosen medical expert has granted a defense motion for summary judgment on causation grounds. Young v. Burton, No. 07-0983 (D. D.C.).
Judge Ellen Segal Huvelle of the U.S. District Court for the District of Columbia ruled on Sept. 8 that plaintiffs' alternative proffer of statements by a defense expert indicating that plaintiffs suffered a "short-term irritant" from mold fell short of proof of causation.
