MINEOLA, N.Y. - A New York trial court has denied a property owner's motion to compel the joint attendance of five office workers at a medical exam to evaluate their mold-related claims, saying such an order would effectively close down their place of business. Feinman v. Colonial Holdings, LLC, et al., No. 1506/07 (N.Y. Sup. Ct., Nassau Cty.).
Nassau County Supreme Court Justice John M. Galasso ordered instead that the defendant property owners schedule independent medical examinations over three days and provide transportation if the exams are out of the county.
