MIAMI - The 11th Circuit Court of Appeals has affirmed summary judgment for an insurance carrier that declined to cover a $1.8 million settlement between a developer and homeowner because it had not approved the settlement. Zurich American Insurance Co. v. Frankel Enterprises, et al., No. 07-14694 (11th Cir.).
The Circuit Court said in an unpublished opinion on July 18 that the U.S. District Court for the Southern District of Florida correctly ruled in favor of Zurich American Insurance Co. based on the developer's clear admission in its answer that it did not obtain the necessary approval.
