N.D. High Court Finds No Coverage for Sellers in Suit by Homebuyer

BISMARCK, N.D. - The North Dakota Supreme Court ruled Sept. 4 that home sellers sued by the buyer over mold contamination cannot look to their former insurer for defense or indemnification. Grinnell Mutual Reinsurance Co. v. Thies, No. 20080017 (N.D. Sup. Ct.).

The high court concluded that a policy issued to the former owners did not provide coverage for the third-party claim made after the sale because it "did not result in bodily injury or property damage caused by an occurrence during the policy period."
