DENVER - A federal judge has remanded to state court a class action alleging that Allstate entities improperly handled homeowners' mold claims, ruling that out-of-state defendants added in a second amended complaint do not provide a basis for removal. Stalnaker, et al. v. The Allstate Corp., et al., No. 07-cv-01748-REB-KMT (D. Colo.).

Judge Robert E. Blackburn of the U.S. District Court for the District of Colorado said in his July 28 remand order that the more liberal removal provisions of the Class Action Fairness Act of 2005 do not apply because the claims against the new defendants relate back to …
