SAN FRANCISCO - A federal judge has vacated a default judgment granted to an insurance company and allowed a third-party to intervene in a declaratory judgment action over a missing EIFS exclusion in a developer's commercial general liability policy. Insurance Corporation of New York v. H&H Plastering Inc., No. C 07-05214 (N.D. Calif.).

Judge William Alsup of the U.S. District Court for the Northern District of California on July 14 granted a motion to intervene by an assignee for the defunct contractor, saying that allowing the intervention would not prejudice the plaintiff insurance company.
