NEW YORK - A New York judge has dismissed personal injury claims brought by a woman against her former landlord, ruling in part that an expert opinion linking her asthma and sinus problems to mold was unsupported by the scientific community. Alvarenga-Duran v. New Whitehall Apartments LLC, No. 108937/04 (N.Y.Sup. Ct., N.Y. Cty.).
New York County Supreme Court Justice Jane S. Solomon denied a motion to grant summary judgment on breach of contract and warranty claims in her June 20 order and, by separate order, transferred those claims to the Civil Court, which ordinarily hears landlord-tenant disputes.
