CHICAGO - A federal appeals court has vacated a $363,038.47 damages award against a mold remediator who lied about his licensing credentials and ordered the trial court to consider the actual value of his services in recalculating damages. United States of America v. Allen, No. 06-3837 (7th Cir.).
The 7th Circuit Court of Appeals said that the U.S. District Court for the Western District of Wisconsin misapplied the federal sentencing guidelines in ordering Neal K. Allen to return the full amount of his contract with the Lac du Flambeau band of the Chippewa tribe.
