SACRAMENTO, Calif. - A California state agency argues in demurring to a complaint filed by state employees that the employees can't avoid the workers' compensation exclusivity provisions by alleging fraud against their employer and the agency that manages the state-owned building. Schroeder v. California State Board of Equalization, et al., No. 34-2008-0004467-CU-MT-GDS (Calif. Super. Ct., Sacramento Cty.).
The California Department of General Services filed its demurrer on May 20 in response to allegations by Wendy Schroeder and 22 other employees of the State Board of Equalization that they became ill from workplace mold exposure.
