RIVERHEAD, N.Y. - A New York trial judge refused to exclude testimony by plaintiff's medical expert Dr. Eckhardt Johanning because of a Frye ruling that went against Johanning in another mold case, but he granted a defense motion for summary judgment on personal injury claims on other grounds. Sweeney v. Great Neck Terrace Owners Corp., et al., No. 4983/2005 (N.Y. Sup., Nassau Cty.).

Nassau County Supreme Court Justice Kenneth A. Davis said in granting the motion on June 12 that the plaintiff failed to offer her own medical causation evidence to counter evidence supporting the motion for summary judgment.
