PHOENIX - An Arizona appeals court has affirmed a jury verdict denying homeowners $849,000 in compensatory and punitive damages they sought from their insurer for its alleged bad faith in denying part of their claim for water and mold damage. Tavilla v. Employer Mutual Casualty Insurance Co., No. 1 CA-CV 06-0764 (Ariz. Ct. App., Div. One).
In an unpublished memorandum decision issued on May 20, the Court of Appeals, Division One, rejected challenges to trial court rulings, jury instructions and an award of attorney fees to Employer Mutual Casualty Insurance Co.
