RIVERHEAD, N.Y. - A New York judge has dismissed third-party claims by an environmental testing firm against an insurance company that hired an allegedly negligent mold remediator. Tessler v. Delta Environmental Consultants Inc., No. 014329/06 (N.Y. Sup. Ct., Nassau Cty.).
Nassau County (N.Y.) Supreme Court Justice Daniel Palmieri said May 19 that a settlement between the insured homeowners and American Insurance Co. (sued as Fireman's Fund Insurance Co.) encompassed any claims for contribution by other parties sued by the homeowners.
